In, 2018 a Trump-era issued memorandum allowed immigration officers to deny incomplete or ineligible applications without issuing RFEs (Requests for Evidence) or NOIDs (Notices of Intent to Deny). The USCIS (United States Citizenship and Immigration Services) recently announced that, going forward, in order to reduce the barriers to legal immigration and to allow for the correction of innocent mistakes, the Department will advise applicants via RFE or NOID that more evidence is needed before denying the application. Homeland Security Secretary Alejandro Mayorkas says the new process will help to modernize the system and assist individuals process through the path to citizenship. An officer may determine that additional evidence may establish eligibility and then issue an RFE or NOID requesting that evidence.
