U.S. Citizenship and Immigration Services (USCIS) issued new policy guidance to clarify the eligibility criteria for the EB-1 immigrant visa classification for individuals with extraordinary ability (E11). Key updates include:
– Recognition of team awards as valid under the criterion for lesser nationally or internationally recognized prizes.
– Clarification that past memberships will be considered under the membership criterion.
– The requirement that published material must demonstrate the value of a person’s work to meet the published material criterion must be removed.
– Explanation that non-artistic exhibitions will only be considered with proper evidence in claims of comparable evidence.
This guidance builds on a previous EB-1 policy update, providing greater clarity and transparency to help petitioners submit the right evidence. It is effective immediately, superseding any previous guidance. More information is available in the USCIS Policy Manual, Volume 6, Part F, Chapter 2.
